Can YOU ‘Reclaim’ Any Land?

WOW – and WOW again!!!!

If anything is likely to put a rocket up your Local Council’s backside this is it! 

Right to (Re)Develop Vacant Property


Grant Shapps, the Coalition Government’s Minister for Housing, has just given the public at large new rights to “Reclaim and (Re)Develop” any publicly owned buildings & land that they can show has lain unused for any significant period of time.

Giving direct support and meaning to the Localism Bill, this new “Community Right to Reclaim Land” gives you and your neighbours the opportunity to (re)develop both land and buildings that have fallen into disuse, become derelict, and/or present an eyesore.

Path Setting Example

Not only has the Minister done this, by the middle of this year he will have also set up an on-line facility – a ‘one-Stop Shop’ for you to get full details of such property AND to ask that this be sold for (re)development.

All Embracing

It will not stop at buildings & land owned, or held, by your Council.  It will also include information on property in the hands of many other Public organisations. Already he has instructed the Homes & Communities Agency to publish details of their holdings (see AssetAdministration@hca.gsx.gov.uk) .

No longer will anyone have to beg for information on vacant sites, or put up with the ‘brush-off’ from local officials.  YOU now have the power to cause them to be brought back into use.

Potential for ‘Community Developers’

Will this lead to local groups being able to set up as ’Community Developers’?

It is, of course, far too early to tell.  And maybe we need tom wait a while for the dust to settle.  But commercial developers and house-builders should not rule out the possibility of setting up collaborative ‘joint ventures’ with local Community Activist Groups.

Anyone who may be interested should enquire direct to AssetAdministration@hca.gsx.gov.uk.  They will acknowledge enquiries and then forward these to the appropriate HCA organisation for them to formally respond.  It is intended to update details of all assets twice each year, in March and September, to coincide with their valuations.

  • Please can Prof Benfield or anyone point to the actual cluse(s) in the localism bill which give effect to the 'right to reclaim?'

    Sorry, I can’t point to the actual clause. However, as directed by Minister for Housing, Grant Shapps, the Homes and Communities Agency has published a detailed list of all its land and property assets. These have been categorised by Local Authority area, type of asset, size and address.

    Recognising the importance this may have in housing delivery, their Chief Executive Pat Ritchie reckons that publishing this information may make it “…easier for Local Authorities and others to see where we might be able to help them achieve their housing and regeneration ambitions in areas across the country”. Any interest should be directed to AssetAdministration@hca.gsx.gov.uk
